DTV vs SMART Visa: Remote Work and Startup Rules

Start with the purpose: workcation, activity or Thai startup

DTV is a consular route for workcation, named activities and qualifying dependants. BOI Announcement Por.5/2568 repealed the 2018 SMART criteria and retains SMART only for foreign entrepreneurs with an already-established, government-certified startup in a targeted Thai industry, plus lawful spouse and legitimate children.

What DTV requires

Validity: 5 years, multiple entry
Stay per entry: up to 180 days; one extension may be granted for up to 180 days
Work evidence: the workcation route asks for foreign-employer, freelance or professional evidence; it does not itself establish permission for Thai employment
Financial evidence: at least 500,000 THB plus the selected mission's purpose evidence; income is not a substitute stated by the MFA summary
Application route: Thai consulate abroad or e-visa portal; no Thai employer sponsor required
New application documents: the central notice effective 31 August adds permanent-residence evidence and criminal-record clearance. Follow the selected mission's updated checklist; see the DTV document change.
Application fee: MFA central summary 10,000 THB; the processing mission publishes its local fee
Categories: documented remote work or freelance work, named activities such as Muay Thai, Thai cooking or medical treatment, and qualifying dependants
Reporting: follow the current Immigration reporting rules for the applicant's actual stay

What current SMART requires

Read the 2025 announcements before older FAQs. BOI's general pages still contain retired category descriptions; they do not reopen the former Talent, Investor or Executive routes for new applications.

Permission: not over 2 years for an established certified startup entrepreneur; continuation requires a new timely application
Stay: subject to the permission granted under the current startup criteria
Work authorisation: no separate work permit is required for work within the certified scope
Financial evidence: at least 600,000 THB, plus 180,000 THB per accompanying dependant, each held for at least three months. The bank may be in Thailand or the applicant's country of nationality or residence.
Application route: BOI qualification endorsement is required before the immigration step
Other conditions: at least 25% of registered capital or company director; health insurance for the whole stay
Categories: current main applicant is the certified startup entrepreneur; lawful spouse and legitimate children may apply as dependants
Reporting: annual BOI status report under Announcement Por.6/2568

After endorsement: Por.6/2568 gives 60 days from the letter to apply for the visa. To continue beyond the current permission, submit the new endorsement application at least 60 days before expiry. These are separate deadlines, not a 60-day processing promise.

The financial evidence is not interchangeable

DTV financial-history wording varies by mission; the mission applies its current checklist, while the MFA central summary does not impose one universal statement period. Current SMART uses the startup deposit, ownership/director, certification and insurance tests above.

Work authority separates the routes

The DTV workcation route asks for foreign-employer or professional evidence. It does not by itself establish permission for Thai employment or Thai-client work. Current SMART grants the certified startup entrepreneur work rights within the approved scope without a separate work permit; other work questions should be checked against current Department of Employment rules.

Pattaya does not change either eligibility test

The cited official sources do not publish Pattaya applicant profiles, local success rates or a Jomtien processing pattern. SMART qualification depends on the certified Thai startup and BOI process, not the applicant's city.

When DTV is relevant

DTV may fit a documented workcation, named activity or qualifying dependant. Eligibility remains purpose- and evidence-specific.

When SMART is relevant

Current SMART is for an entrepreneur who established a certified startup in a targeted Thai industry and meets the published ownership/director, deposit, insurance and immigration conditions. BOI grants work permission within the certified scope without a separate work permit.
