The legal frame

Crypto trading from Thailand as a foreigner has three legal questions: (1) Is your activity considered work? (2) Is it taxable income to Thailand? (3) Are you using a Thai-licensed exchange?

Personal trading of your own capital with no Thai clients is not "work" under Thai labor law — DTV permits this perfectly. Trading other people's money as a professional service requires SEC Thailand licensing + work permit. Operating a DeFi protocol or running an OTC desk for Thai customers is regulated business activity requiring formal licensing.

Pathway 1 — DTV (most crypto traders)

If you trade your own capital remotely, your visible income is from foreign exchanges (Binance, Bybit, Kraken), and you have $80k+/yr or 500k THB liquid, DTV fits. 5-year multi-entry. No work permit. No Thai-source income concerns provided you trade on offshore exchanges.

Pathway 2 — LTR Wealthy Global Citizen (high net worth)

If you hold $1M+ in crypto + cash + investments and earn $80k+/yr, LTR-WGC is the premium path. The $500k Thai investment requirement is the tradeoff — can be in BOI-promoted real estate. Royal Decree 743 exemption on foreign-source income remitted to Thailand is the killer feature for traders who realise gains offshore.

Tax warning

Thailand began enforcing crypto-gain taxation in 2024. If you are tax-resident (180+ days/yr) and remit crypto-converted-to-fiat into Thailand, the gain is taxable income at progressive rates 5-35%. The LTR exemption avoids this; DTV does not.

Pattaya scene

Pattaya has a growing crypto community concentrated in Jomtien. Several DeFi developers and OTC traders are based here for tax efficiency + cost of living. Bangkok has more institutional players.
