Legal reality — read first

"Real estate broker / agent" is technically on the restricted-occupation list for foreigners in Thailand. The reality on the ground in Pattaya: many foreign-owned agencies operate openly with foreign staff. The legal workaround is that the foreign "agent" is technically employed in a non-restricted role (marketing manager, sales executive, business development) and the actual brokering is done through Thai-named licenses.

Pretending to be an "agent" on a tourist visa, with no work permit, while collecting commissions in Thailand is illegal employment. Several Pattaya agencies have been raided in 2023-2024 with foreign staff deported.

Pathway 1 — Agency-sponsored Non-B + work permit

An established Pattaya real estate agency (Hipflat, FazWaz, Pattaya Property, individual major brokerages) sponsors you under a permitted job title — "marketing director," "international sales manager," "client liaison" — with full Non-B + work permit. ฿50k+/month declared salary. The agency's Thai license-holder is the technical broker; you handle foreign clients in a permitted advisory capacity.

Pathway 2 — Open your own agency

Thai limited company + Thai-named property broker license + ฿2M paid-up + 4 Thai staff per foreign work permit. The Thai partner or employee holds the license; you operate the foreign-facing brand. Common structure in Pattaya. Realistic startup: ฿400k-1M.

The DTV grey zone

Online property marketing for foreign clients (Thailand property YouTube channel, foreign-language buyer guides, etc.) fits DTV. But the moment you start collecting commissions on Thai-soil transactions, you have crossed into restricted-occupation work and the DTV does not legally cover this.

Pattaya real estate market

100+ agencies in Pattaya, ~40% have foreign management. Commission norms: 3-5% on sales, 1 month rent on rentals. Average foreign-staff income (declared salary + commission): ฿80-300k/month at established mid-tier agencies; top performers at premium agencies clear ฿500k+. The market is huge — Russian, German, British, Scandinavian, American, Indian, Chinese buyer segments all need dedicated language coverage.
