The legal reality for foreign chefs

"Chef" in Thai work permit law splits into two categories: specialty cuisine (Japanese, Italian, French, Indian, etc. — fully permitted with proper documentation) and Thai cuisine (effectively restricted to Thai nationals at most ranks). A foreign "Thai chef" is rare and usually requires BOI promotion or hotel-chain employment.

Pathway 1 — Restaurant or hotel sponsorship + Non-B

Most foreign chefs in Thailand are sponsored by hotels (Marriott, Hilton, Hyatt, Anantara) or established standalone restaurants. Minimum declared salary: ฿50,000/month at independents, ฿80,000-150,000/month at 5-star hotels. The employer handles paperwork. Annual renewal.

Hotel chains often have streamlined BOI-promoted visa processes that bypass the standard "1 foreign work permit per 4 Thai employees" rule. Independent restaurants without BOI promotion face that ratio strictly.

Pathway 2 — Open your own restaurant + Non-B

Form a Thai limited company. Restaurant business is open to foreigners with 49% ownership (Thai majority partner required). ฿2M paid-up capital minimum for work permit eligibility. 4 Thai employees per foreign work permit.

Reality: starting a restaurant in Pattaya costs ฿1.5-5M including lease, fit-out, kitchen, and 6-month operating runway. Success rate at 18 months is below 30%. Most foreign-owned Pattaya restaurants are co-founded with Thai partners who handle local licensing.

Pathway 3 — DTV (very narrow fit)

If you are a culinary content creator earning from YouTube, cookbook royalties, or paid cooking class videos for foreign students, DTV fits. If you cook for Thai customers in Thailand, DTV does not legally cover this.

Pattaya has 500+ foreign-owned restaurants — Italian, German, Russian, Indian, Japanese, English pub fare. Walking Street, Soi Buakhao, Jomtien Beach Road are highest density. Average head-chef salary ฿70-120k/month at mid-tier; ฿150-250k at 5-star hotels (Hilton, Hard Rock).
